Article 99: Prohibited Subsidies
- Subject to this Treaty, a Member State shall neither grant nor maintain subsidies referred to in paragraph 2.
- The following subsidies within the meaning of Article 96 shall be prohibited:
(a) subsidies contingent, in law or in fact, whether solely or as one of several other conditions, upon export performance, including those listed in Schedule V; and
(b) subsidies contingent, whether solely or as one of several other conditions, upon the use of domestic over imported goods.
- Nothing in this Article shall be construed as applying to agricultural commodities produced in the Community.
